Damages for Personal Injury- a New Guide

The team at Penmans has, for many years, been helping innocent victims of accidents and clinical
negligence to recover compensation both for their physical injuries and the financial losses they
have suffered.

During that time we have dealt with a wide range of cases; from minor injuries attracting only
modest compensation to life changing injuries where compensation has been measured in hundreds

All of these cases have two things in common.

First, in order to claim compensation then the injury must arise from the negligence of a third party.
Life is not perfect and accidents do happen where someone else is not to blame. But if the injury is

The second thing is that all cases of compensation are calculated in the same way. The purpose of a
claim is to put the victim, as far as is possible, back into the position they would have been had the
accident not occurred.

Clearly a sum of money cannot mend an injury or remove pain. Guidance is given to the Courts and
case law over the years has established the level of compensation that is appropriate for any specific
injury. We will always give guidance and advice on the appropriate level of compensation.
In addition, we can help with the calculation of financial losses, both past and into the future, which
is often a complex issue.
